Inspector alleges oil field services company failed to pay overtime

HOUSTON — A Montgomery County man has filed a class action lawsuit against an oil field services company, alleging violation of workers compensation acts in failing to pay overtime.

Bryan Shepard, individually and on behalf of all others similarly situated, filed a complaint June 5 in the Houston Division of the Southern District of Texas against TurnCo LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, between April 2013 and August 2015, Shepard regularly worked for TurnCo as an inspector of drilling equipment for more than 40 hours a week without overtime compensation. The plaintiff alleges TurnCo misclassified him as exempt from overtime and the defendant continues to ignore the requirement to pay overtime when its employees work more than 40 hours a week as required by FLSA.

Shepard seeks trial by jury, an order designating this case as a collective action, unpaid overtime compensation and liquidated damages, attorney fees, court costs and expenses and all other necessary and appropriate relief. He is represented by attorney Don J. Foty of Kennedy Hodges LLP in Houston.
