Black employee accuses excavating company of discrimination

SHERMAN — A black Dallas County man is suing an excavation company, alleging discrimination, retaliation and wrongful termination.

E. Louis G. Darden filed a complaint June 5 in the Sherman Division of the Eastern District of Texas against Mario Sinacola & Sons Excavating Inc. alleging his former employer violated the Age Discrimination in Employment Act.

According to the complaint, as a result of the defendant's discriminatory practices, Darden, 73, suffered lost wages, emotional pain, inconvenience and loss of enjoyment of life. He was terminated Sept. 17, 2016, the suit says, after six years of working for Sinacola & Sons. 

The plaintiff alleges the defendant subjected him to disparate treatment, employment discrimination, hostile work environment, retaliation and wrongful termination.

Darden seeks trial by jury, judgment for all damages sustained by the plaintiff, interest, attorney fees, court costs and expenses and all other, further relief. He is represented by attorney Allison Bedore of Law Office of Allison Bedore in Weatherford.
