Inmate blames transport providers, law enforcement officials for injuries

HOUSTON — An inmate is suing transport service providers and Harris County law enforcement, alleging their negligence caused injuries to the plaintiff.

Gary Lewis France of Chino Hills filed a complaint June 8 in U.S. District Court for the Southern District of Texas against Prisoner Transport Services of America LLC, the Harris County Sheriff's Office, Harris County Commissioners, Ed Gonzalez, Rodney Ellis, et al, alleging they violated the Eighth and 14th Amendments to the U.S. Constitution.

According to the complaint, during France's  13-day extradition from Salt Lake City to Houston, he experienced dehydration, heat stroke, disorientation and loss of consciousness in a transport van because the defendants negligently confined the plaintiff in an environment with intolerable heat levels and failed and refused to provide proper medical assistance and treatment.

France seeks trial by jury, judgment in excess of $75,000, plus interest, costs of court and punitive damages. He is represented by attorney Peter R. Nasmyth Jr. of Law Office of Peter R. Nasmyth Jr. in Claremont, California.
