Former employee claims G.W. Phillips Concrete Construction failed to pay overtime premium

HOUSTON — A construction worker has filed a class-action lawsuit against his former employer, citing alleged violation of workers compensation acts.

Luis Marin, individually and on behalf of all others similarly situated, filed a complaint June 9 in the Houston Division of the Southern District of Texas against G.W. Phillips Concrete Construction Inc. and George W. Phillips III, alleging they violated the Fair Labor Standards Act (FLSA).

According to the complaint, the plaintiff alleges he regularly worked 60 hours or more per week but was not paid any overtime premium for hours worked over 40 in the week. Instead, he was paid the same hourly rate for all hours worked. The plaintiff holds G.W. Phillips Concrete Construction and Phillips responsible because the defendants allegedly recklessly disregarded the overtime provisions of the FLSA by not paying the required overtime premium.

The plaintiff requests a trial by jury and seeks unpaid overtime wages, liquidated damages, pre-judgment interest, attorney’s fees and such other just and equitable relief. He is represented by Josef F. Buenker and Vijay A. Pattisapu of The Buenker Law Firm in Houston.
