Delivery driver alleges Papa John's failed to pay overtime

HOUSTON — A Washington County woman has filed a class action lawsuit against Papa John’s, alleging violation of workers compensation acts in failing to pay overtime.

Jennifer Gibbons, individually and on behalf of all others similarly situated, filed a complaint June 9, in the Houston Division of the Southern District of Texas against NA Pizza, doing business as Papa John’s LLC, Ahmer Ghauri and/or Naveed Rehman, alleging they deliberately violated the the minimum wage and overtime provisions of the Fair Labor Standards Act.

According to the complaint, between June 2015 and May 2016 Gibbons routinely worked in excess of 40 hours per week, first as a delivery driver and then as a manager without receiving the federally mandated minimum wage or the proper amount of overtime compensation for all hours worked in excess of 40 hours. 

The plaintiff alleges the defendants utilized timekeeping techniques that did not adequately compensate employees for all hours worked.

Gibbons seeks trial by jury, an order recognizing this proceeding as a collective action, compensatory and liquidated damages, attorney fees and costs, pre- and post-judgment interest and all other necessary and appropriate relief.
