Houston Foam Plastics alleges former employee sent confidential information to email account without permission

HOUSTON – An El Paso man is accused of unlawfully emailing his former employer's confidential information to his personal email account.

Houston Foam Plastics Inc. filed a complaint on June 16 in the Harris County District Court against Fernando Tamez alleging that the employee violated the Texas Uniform Trade Secret Act and other counts.

According to the complaint, the defendant is a former employee of the plaintiff. The plaintiff alleges that the defendant sent confidential information and trade secrets to his personal Gmail account. The suit states his employment was terminated with the plaintiff on June 16. The plaintiff believes that the defendant intends to use the information to target the plaintiff's customers and unfairly compete with it.

The plaintiff requests a trial by jury and seeks actual and punitive damages, pre- and post-judgment interest, attorney's fees, costs and expenses and such other relief to which plaintiff is justly entitled.
