Alanza Brook Apartments tenant alleges negligent security led to her attack on premises

HOUSTON – A Harris County resident alleges that the managers of the apartment community where she lives failed to repair a broken gate and provide rigorous security to ensure the safety of its tenants.

Marian Kachakech filed a complaint on June 20 in the Harris County District Court against FSC Morningside/Alanza Brooks Associates LLC alleging negligence.

According to the complaint, the plaintiff and her family were tenants at the defendant's Alanza Brook Apartments beginning in March 2016. The suit states that on Sept. 21, 2016, she was robbed and raped at gunpoint by an unknown attacker right on the defendant's premises. The suit states the attacker was later apprehended.

The plaintiff holds FSC Morningside/Alanza Brooks Associates LLC responsible because the defendant allegedly failed to have adequate and sufficient security systems and failed to warn tenants of the foreseeable risk or danger.

The plaintiff requests a trial by jury and seeks monetary relief reasonable to compensate plaintiff's damages, pre- and post-judgment interest, costs of suit and such other just and equitable relief. She is represented by Jill Yaziji of Yaziji Law Firm in Houston.
