Guardian alleges man was injured during transport by Acute Medical Services

HOUSTON – A guardian has filed suit against a transportation service over allegations her ward was injured because his wheelchair was not properly secured.

Rebecca May Williams, as guardian of the person and estate of Manuel Kimber, filed a complaint on June 21 in the Harris County District Court against Acute Medical Services LLC alleging negligence.

According to the complaint, on June 23, 2015, Kimber was released in a wheelchair to a driver of the defendant, who was supposed to secure Kimber in a wheelchair transportation van. The suit states the driver failed to secure him and he was forced to the floor during transport, causing injury.

The plaintiff holds Acute Medical Services LLC responsible because defendant's driver allegedly failed to adequately secure Kimber and failed to make a proper application of the brakes of the vehicle.

The plaintiff requests a trial by jury and seeks actual, compensatory and exemplary damages, plus interest, costs of court, attorney's fees and such other general and special relief. She is represented by Karen M. Alvarado of Brothers Alvarado PC in Houston and Lance H. Lubel of Lubel Voyles LLP in Houston.
