Carousel operator blames Kemah Boardwalk for injuries

GALVESTON — A Harris County man is suing a Kemah amusement area operator, alleging negligence led to injuries for the plaintiff.

Daniel Carpency filed a complaint June 28 in Galveston County District Court against Landry’s Crab Shack Inc., doing business as Kemah Boardwalk, alleging failure to provide a safe workplace.

According to the complaint, on July 27, 2016, Carpency was working as a carousel operator. The suit says Carpency, who had worked four straight hours without a break, sustained injuries when he slipped on the stairs while exiting the carousel area. 

Carpency says he has suffered pain, mental anguish, medical expenses and reduction of earnings. The plaintiff alleges Kemah Boardwalk failed to provide adequate and proper breaks and failed to provide proper assistance and training.

Carpency seeks trial by jury, monetary relief of more than $200,000, but not more than $1 million and all other equitable relief. He is represented by attorneys Loren G. Klitsas and Jared W. Capps of Klitsas & Vercher PC in Houston.
