Repair service alleges contractor owes more than $112,000

HOUSTON — A Katy repair service provider is suing a Houston contractor , alleging breach of contract in failing to pay more than $112,000.

Erick Ashe, doing business as, Elite Emergency Solutions, filed a complaint July 3 in Harris County District Court against Kilgore Industries LP, alleging the contractor says it is seeking payment from an insurance for a water-damaged building in Houston.

According to the complaint, in August 2016, Ashe provided repair services to water damage in a building at 1699 Hermann Drive, Houston. Ashe says he presented invoices to defendant totaling $112,510.97.

The suit says this amount remains due and owing. The plaintiff alleges Kilgore Industries has failed and refuses to tender payments in a timely manner and maintained that the amount owed is not due.

Ashe seeks trial by jury, actual damages of not less than $112,510.97, pre- and post-judgment interest, attorney fees, costs of suit and all other relief. He is represented by attorney Hessam Parzivand of The Parzivand Law Firm PLLC in Sugar Land.
