Former employee alleges Century 21 failed to pay proper wages

LUFKIN — A Lufkin man is suing Century 21, alleging retaliation, violation of applicable minimum wage law and wrongful termination.

David Mark Davis II filed a complaint July 5 in the Lufkin Division of the Eastern District of Texas against Abigail Enterprises Inc., doing business as Century 21 Cota Realty, alleging violation of the Fair Labor Standards Act.

According to the complaint, Davis, who began working for Century 21 on Feb. 6,  was damaged financially for not receiving the statutory minimum wage rate, employment benefits, workplace safety protection or contribution to social welfare retirement. 

The plaintiff alleges Century 21 Cota Realty classified him as an independent contractor, refused to pay the minimum wage and retaliated against him by terminating his employment for complaining of FLSA violations.

Davis seeks trial by jury, reinstatement, actual and punitive damages, pre-and post-judgment interest, costs of suit and all appropriate relief. The plaintiff is representing himself.
