Worker blames employer, scaffold provider for injuries

GALVESTON — A Harris County man is suing his employer and a scaffold provider, alleging their negligence caused injuries.

Guillermo Mendez filed a complaint July 6 in Galveston County District Court against The Brandt Companies LLC and Valero Energy Corporation, alleging they failed to provide a safe workplace and proper equipment for the job.

According to the complaint, on Jan. 29, Mendez was working at Valero's refinery in Texas City when he sustained serious injuries to his brain, neck and shoulders after falling from an unsafe scaffold. He says he has suffered pain and weakness on his arm, hand and shoulder, serious headaches, neck pain and diminished brain function. 

The plaintiff alleges the defendants failed to properly install and inspect the scaffold and failed to warn plaintiff of dangers associated with the equipment.

Mendez seeks trial by jury, damages of more than $1 million, interest, court costs and all other just relief. He is represented by attorneys Jim Hart, Eloy E. Gaitan and Cesar Tavares of Williams Kherkher Hart Boundas LLP in Houston.
