Former employee accuses engineering company of discrimination

HOUSTON — A Harris County man is suing an engineering company, alleging unlawful discrimination and retaliation.

Daniel Caplan filed a complaint July 7 in the Houston Division of the Southern District of Texas against Fluor Enterprises Inc., alleging the defendant wrongfully interfered with his Family and Medical Leave Act rights.

According to the complaint, Caplan suffered loss of wages and benefits, mental anguish, pain and suffering, damage to his reputation, loss of enjoyment of life, inconvenience and other damages after he was fired Aug. 1, 2016. 

The plaintiff alleges Fluor Enterprises failed to provide reasonable accommodation and to engage in an interactive process when Caplan began suffering digestive medical issues and retaliated against him by terminating his employment for seeking accommodations under the ADAAA.

Caplan seeks trial by jury, compensatory and punitive or exemplary damages, attorney fees, court costs, interest and all other equitable relief. He is represented by attorney Nitin Sud of Sud Law PC in Bellaire.
