HOUSTON – A man alleges he was improperly classified as an independent contractor and was not paid overtime by an oilfield service company.
Shadden Culley, individually and on behalf of all others similarly situated, filed a complaint on July 10 in the Houston Division of the Southern District of Texas against Inwell Inc. and MWD Services (MGMT) Inc. alleging that they willfully violated the Fair Labor Standards Act.
According to the complaint, the plaintiff was employed by the defendants as an MWD operator from September 2010 to January 2015 and from November 2016 to May 2017. He alleges that he routinely worked in excess of 40 hours per week but did not receive proper overtime compensation for all hours worked in excess of 40 hours per workweek.
The plaintiff requests a trial by jury and seeks an order recognizing this case as a collective action, award for unpaid back wages, liquidated damages, pre- and post-judgment interest and such other and further relief.
