Delivery driver alleges Royal AC Inc. failed to pay correct overtime rate during his employment

HOUSTON – A Houston business is alleged to have paid a former employee straight time for overtime work.

Ascencion Caldera filed a complaint on July 11 in the Houston Division of the Southern District of Texas against Royal AC Inc., George Saleh and Sam Mukattash alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants as a delivery driver and warehouse worker from June 2014 to April 2017.

The plaintiff holds Royal AC Inc., Saleh and Mukattash responsible because the defendants allegedly failed and refused to pay plaintiff for the additional half-time premium for all overtime hours worked in excess of 40 hours per workweek.

The plaintiff requests a trial by jury and seeks actual damages, liquidated damages, attorney’s fee and costs and such other lawful and equitable relief. He is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
