Transgender engineer accuses Phillips 66 of sex discrimination

HOUSTON — A transsexual woman is suing Phillips 66, alleging sex discrimination.

Nicole C. Wittmer filed a complaint July 17 in the Houston Division of the Southern District of Texas against Phillips 66 Company, alleging violation of Title VII of the 1964 Civil Rights Act.

According to the complaint, Wittmer was subjected to adverse employment actions in connection with the compensation, terms, conditions and privileges of her employment. She says she has suffered, lost wages and benefits, plus physical and mental pain. 

The plaintiff alleges Phillips 66 intentionally engaged in unlawful employment practices and rescinded her employment offer because she was a transgender woman.

Wittmer seeks trial by jury, compensatory and punitive damages, reinstatement, attorney fees, costs of court, pre- and post-judgment interest and all other lawful and equitable relief. She is represented by attorneys Alfonso Kennard Jr. and Jose E. Galvan of Kennard Richard PC in Houston.
