Patient alleges Tomball Regional Medical Center lien is invalid

Medical malpractice 05

HOUSTON – A Travis County woman alleges that a hospital filed an invalid lien against her.

Jennifer Olson filed a complaint on July 21 in the Harris County District Court against Tomball Texas Hospital Co. LLC, doing business as Tomball Regional Medical Center, alleging that the medical care provider violated the Deceptive Trade Practices Act.

According to the complaint, the plaintiff alleges that as a result of the injuries she sustained in a motor vehicle collision on July 22, 2015, she sought defendant's services for treatment. At the time of the accident, the suit states that she had health insurance coverage with Blue Cross Blue Shield, which had a deal with the defendant that any charges not paid by Blue Cross would be waived and not be the responsibility of the patient.

The plaintiff holds Tomball Texas Hospital Co. responsible because the defendant allegedly filed a lien against her in 2015 and is attempting to collect $15,930.17 for services provided to the plaintiff.

The plaintiff requests a trial by jury and seeks an order declaring that defendant's lien is invalid, award for all damages, plus interest, costs of court, attorney's fees and all further relief to which she is entitled. She is represented by Derrel Luce of Luce Law Firm in Waco.
