HOUSTON – A Lewisville man is seeking the court's judgment that he is not bound or restricted by an agreement with his former Spring employer.

Jeffrey Harader filed a complaint on July 28 in the Harris County District Court against Electra Link Inc. seeking declaratory judgment.

According to the complaint, the plaintiff is a former employee of the defendant and signed a confidentiality and noncompete agreement in 2015. The suit states the plaintiff resigned in May and is now employed by Smart Systems, but there is a controversy between the parties regarding the agreement. The plaintiff claims he is not prohibited from employment with Smart Systems because of the agreement.

The plaintiff seeks an order declaring that the non-compete and non-solicitation provisions of the agreement are unenforceable, interest and attorney's fees. He is represented by Lionel Martin of Garcia-Martin & Martin PC in Sugar Land.
