HOUSTON – A registered nurse alleges a Webster medical facility failed to pay for all hours worked.

Ekugbere “David” Bazunu, individually and on behalf of all others similarly situated, filed a complaint on Aug. 4 in the Houston Division of the Southern District of Texas against Bay Area Regional Medical Center alleging that the medical facility violated the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendant from August 2016 to June 2017. He alleges the defendant's timekeeping software automatically deducted a half hour of time for each 12-hour shift for meal breaks, but that he and other nurses routinely worked through these breaks.

The plaintiff holds Bay Area Regional Medical Center responsible because the defendant allegedly failed to pay overtime compensation.

The plaintiff requests a trial by jury and seeks compensation for all unpaid overtime hours worked, liquidated damages, attorney’s fees, costs and expenses and all further relief to which she and the class members may be entitled. He is represented by Todd Slobin and Ricardo J. Prieto of Shellist Lazarz Slobin LLP in Houston.
