Nurse alleges Divine Healers did not pay the correct rate for overtime work

HOUSTON – A licensed vocational nurse alleges that a home health care provider failed to pay the appropriate rate for overtime work.

Victor Garcia, individually and on behalf of all others similarly situated, filed a complaint on Aug. 8 in the Houston Division of the Southern District of Texas against Divine Healers Inc., doing business as Healing Hands Healthcare, alleging that the home health care provider violated the Fair Labor Standards Act.

According to the complaint, the plaintiff worked for the defendant from 2015 until August and alleges that he regularly worked in excess of 40 hours per week without receiving proper overtime compensation. The plaintiff holds Divine Healers Inc. responsible because the defendant allegedly failed to pay a rate of one-and-one-half times the regular rates of pay for all hours worked in excess of 40 hours per week.

The plaintiff requests a trial by jury and seeks unpaid back wages, liquidated damages, interest, attorney fees, costs and expenses and such other necessary and appropriate relief. He is represented by Edmond S. Moreland Jr. and Daniel A. Verrett of Moreland Law Firm PC in Wimberley.
