Widow seeks $1 million after husband was struck by tow truck in Houston parking lot

HOUSTON – A Harris County widow alleges the negligence of a parking lot owner contributed to the death of her husband.

Emma Garcia filed a complaint on Aug. 8 in the Harris County District Court against Brixmor GA Apollo 1 TX Holdings LLC alleging negligence, wrongful death and other counts.

According to the complaint, the plaintiff alleges that on Jan. 27, her husband Jose Garcia died when he was struck, run over and killed by a tow truck at defendant's parking lot on Aldine Mail Route Road in Houston. 

The plaintiff holds Brixmor GA Apollo 1 TX Holdings LLC responsible because the defendant allegedly failed to provide a safe ingress and egress for business patrons and failed to take proper actions to prevent unauthorized vehicles from trespassing on the property.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1,000,000 and all other relief that are lawful and equitable. She is represented by R. James Amaro and Ashlee Dunham of The Amaro Law Firm in Houston.
