HOUSTON – A Harris County individual claims that he is owed more than $350,000 for a settlement.
David E. Marcus filed a complaint on Aug. 8 in the Harris County District Court against Plan B Real Estate LLC, Timothy R. Akers, Maximiliano Fiano, Medical Group Inc. and Medical Group Holdings alleging breach of contract.
According to the complaint, the plaintiff alleges that on Jan. 26, 2015, and Oct. 1, 2015, he made several loans to defendants that they defaulted on. The suit states that a settlement was reached on April 7 for the defendants to pay the plaintiff $365,000 before Aug. 1 in exchange for the plaintiff to release them from their obligations under the defaulted notes. He alleges the defendants failed to make this payment.
The plaintiff seeks damages equal to plaintiff's loss, prejudgment and post-judgment interest, attorney's fees and costs. He is represented by Jeremy Doyle of Reynolds Frizzell LLP in Houston.
