Buyer alleges San Leon property owner failed to sign documents

GALVESTON – A San Leon woman is alleged to have failed to sign documents needed to transfer her property to a buyer.

Chris Harrison, as assignee of Tabitha Cruz, filed a complaint on Aug. 10 in the Galveston County District Court against Cheryl Stone, also known as Cheryl Conklin, alleging breach of contract.

According to the complaint, the plaintiff alleges that on Feb. 3, defendant agreed to sell the property at 925 Ninth St. San Leon to Cruz for $85,000. The suit states Cruz was made a $50,000 down payment to purchase the property. 

The plaintiff holds Stone responsible because the defendant allegedly refused to sign the documents necessary to transfer the property.

The plaintiff seeks monetary relief of $100,000 or less and such other lawful and equitable relief. He is represented by Chuck Portz of Portz, Portz & Pena in Houston.
