HOUSTON – A construction company is alleged to have terminated a superintendent in retaliation for his complaints about unpaid overtime wages.
Darryl Ray filed a complaint on Aug. 15 in the Houston Division of the Southern District of Texas against Dixon Services Inc., doing business as Construction LTD, Applied Architectural Products Inc. and Sovereign Builders Inc. alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff was employed by the defendants in the Harris County and Montgomery County territories as a superintendent.
The plaintiff holds Dixon Services Inc., Applied Architectural Products Inc. and Sovereign Builders Inc. responsible because the defendants allegedly failed to pay him for any hours worked over 40 in a workweek, retaliated against him and terminated his employment on Aug. 8 for complaining about his lack of overtime compensation.
The plaintiff requests a trial by jury and seeks monetary damages, liquidated damages, attorney’s fees and costs and such other and further relief. He is represented by Joshua A. Verde of The Verde Law Firm PLLC in Houston.
