Consumers allege Bournview Recovery Group violated debt collection laws

SHERMAN – A Van Alstyne resident and an Anna resident have filed a class action suit against a New York debt collector over allegations that it violated collection laws.

Kendall Morin and Karla Chandler, individually and on behalf of all others similarly situated, filed a complaint Aug. 23 in the Sherman District of the Eastern District of Texas against Coastal Capital Processing LLC, doing business as Bournview Recovery Group, alleging that the third-party debt collector violated the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, Morin allegedly incurred a debt that was transferred to the defendant for collection. The suit states that Morin disputes the amount the defendant is attempting to collect.

Chandler alleges that the defendant has called her cellphone using an automatic telephone dialing system and that she has never had a business relationship with the defendant or given it permission to call her. Chandler is Morin's mother, the suit states.

The plaintiffs hold Coastal Capital Processing LLC responsible because the defendant allegedly made calls using an automatic telephone dialing system and/or an artificial or prerecorded voice.

The plaintiffs request a trial by jury and seek statutory and treble damages, attorney’s fees and costs and other and further relief as the court deems just and proper. They are represented by Jeffrey D. Wood of The Wood Firm PLLC in Little Rock, Arkansas.
