Man alleges Liberty Auto Sales Inc. paid straight time for all hours worked

HOUSTON – A family-owned used car business is alleged to have failed to pay an employee the correct rate for overtime work.

Rolando Ruiz filed a complaint on Aug. 24 in the Houston Division of the Southern District of Texas against Liberty Auto Sales Inc. and Jerry M. Baker alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he regularly worked at least 50 hours per week for defendants without being paid proper overtime compensation for those overtime hours. The plaintiff holds Liberty Auto Sales Inc. and Baker responsible because the defendants allegedly did not properly their former employees at a rate of one-and-one-half times their regular hourly rate of pay for all hours worked over 40 per workweek.

The plaintiff seeks to recover unpaid overtime compensation, liquidated damages, plus interest, attorneys' fees, costs and expenses and such other and further relief. He is represented by Mark Siurek and Patricia Haylon of Warren & Siurek LLP in Houston.
