HV BTW LP files suit over alleged easement agreement with Houston Community College System

HOUSTON – A partnership doing business in Harris County is seeking declaration from the court regarding an easement agreement.

HV BTW LP filed a complaint on Aug. 24 in the Harris County District Court against Houston Community College System alleging breach of contract.

According to the complaint, the plaintiff owns a building and parking garage in Houston and the defendant owns a vacant lot adjacent to it. The plaintiff approached the defendant about an easement for its tenants to have access to the plaintiff's property, and the easement was granted in October 2013.

The suit states that the defendant claims the individual that signed the agreement had done so without authority and that the defendant is not bound to the agreement. The plaintiff alleges it has spent "hundreds of thousands of dollars" complying with its obligations under the agreement.

The plaintiff seeks monetary relief of more than $1 million and such other general, special, legal and equitable relief. It is represented by Joseph O. Slovacek and Paul A. Pilibosian of Hoover Slovacek LLP in Houston.
