GKL Recovery & Acquisitions alleged to have used misleading collection practices

BROWNSVILLE – A Houston consumer alleges a letter sent from California collection agency misled her into believer she needed to pay an alleged debt immediately or the amount would increase.

Argentina Rincon, individually and on behalf of all others similarly situated, filed a complaint on Aug. 30 in the U.S. District Court for the Southern District of Texas against Monterey Collections and GKL Recovery & Acquisitions alleging that it violated the Fair Debt Collections Practices Act.

According to the complaint, the plaintiff received a letter from the defendant in August 2016 that stated fees on the alleged debt could increase after a certain date and was confusing to the plaintiff on how she could dispute the alleged debt.

The plaintiff holds Monterey Collections and GKL Recovery & Acquisitions responsible because the defendants allegedly made false representation of the amount of the debt and failed to clearly convey the information.

The plaintiff requests a trial by jury and seeks actual and statutory damages, attorneys’ fees, costs and expenses, pre- and post-judgment interest and such other just and proper relief.
