Former student accuses Texas Tech University of disability discrimination

LUBBOCK – A former student in Texas Tech University's physician assistant program in Midland alleges she was discriminated against because of her disability.

Marily Flores filed a complaint on Aug. 30 in the U.S. District Court for the Northern District of Texas, Lubbock Division against Texas Tech University alleging violation of the Americans with Disabilities Act and Section 504 of the Rehabilitation Act.

According to the complaint, the plaintiff has ADD/ADHD and other medical issues and needs medication and accommodation.

The plaintiff holds Texas Tech University responsible because the defendant allegedly failed to provide reasonable accommodations, wrongfully discriminated against her and immediately and permanently dismissed her without leave to reapply.

The plaintiff requests a trial by jury and seeks injunctive relief to reinstating her as a student in good standing, award for damages in an amount of more than $75,000, attorney’s fees, costs and disbursements and any further relief as justice requires. She is represented by Jason J. Bach of The Bach Law Group PLLC in Austin.
