Walmart shopper seeks at least $200,000 after slipping in puddle in store

BEAUMONT – A Nederland Walmart shopper claims that he was injured in a fall while in the store.

David Herber filed a complaint on Sept. 7 in the Jefferson County District Court against Wal-Mart Stores Texas LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 28, 2015, he was severely injured when he slipped and fell due to a puddle of water on the floor at defendant's Walmart store in Nederland. He alleges he sustained injuries to his legs, neck, low back and right shoulder. 

The plaintiff holds Wal-Mart Stores Texas LLC responsible because the defendants allegedly failed to eliminate the dangerous condition and failed to warn its customers of the existence of such condition.

The plaintiff seeks monetary relief of more than $200,000 but not more than $1 million and such other just and proper relief. He is represented by Jonathan C. Juhan and J.J. Bragg of Jonathan C. Juhan in Beaumont.
