BEAUMONT – A Gulf Coast terminal operator in Nederland is seeking damages after a vessel struck a dolphin.

Energy Transfer Partners LP filed a complaint on Aug. 26 in the Jefferson County District Court against Marquette Transportation Co. Gulf-Inland LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 28, 2015, it suffered damages when defendant's vessel Lady of Prompt Succor collided with a dolphin at its facility. The plaintiff states that the removal cost totaled $29,500.

The plaintiff holds Marquette Transportation Co. Gulf-Inland LLC responsible because the defendant allegedly failed to reimburse actual expenses relating to the damaged dolphin.

The plaintiff requests a trial by jury and seeks monetary relief of $100,000 or less, pre- and post-judgment interest, penalties, costs and such other just and proper relief. It is represented by Seth I. Rubinson of Rubinson Law in Houston.
