Consumer claims Charter Communications Inc. has wrong number

BEAUMONT – An Orange consumer alleges she has been called hundreds of times by a communications company in its attempt to reach an unknown person.

Monica Scruggs filed a complaint on Sept. 14 in the Beaumont Division of the Eastern District of Texas against Charter Communications Inc., doing business as Spectrum, alleging that the debt collector violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that she has been receiving incessant unwanted calls from defendant attempting to collect a debt from an unrelated third party. As a result, she alleges she has been damaged, harassed, stressed, frustrated and annoyed.

The plaintiff holds Charter Communications Inc. responsible because the defendant allegedly invaded her right to privacy and continued to call after she advised it that it had the wrong number.

The plaintiff requests a trial by jury and seeks trebled damages of $1,500 and statutory damages of $500 per call, costs, expenses and disbursements and such other and further relief. She is represented by Yitzchak Zelman of Marcus & Zelman LLC in Ocean, New Jersey.
