Consumer claims East Coast Equipment Group Inc. delivered incorrect excavator

GALVESTON – An Anahuac consumer claims that an excavator he ordered was not the one he received.

Nathan Trahan filed a complaint on Sept. 14 in the Galveston Division of the Southern District of Texas against East Coast Equipment Group Inc. alleging that the Florida corporation violated the Texas Deceptive Trade Practices Act.

According to the complaint, the plaintiff alleges that on March 15, he transmitted and wire transferred to defendant the amount of $32,500 as payment for the excavator that he ordered. Upon inspection, the plaintiff alleges that the defendant delivered a unit that has a different serial number and has mechanical deficiencies. 

The plaintiff holds East Coast Equipment Group Inc. responsible because the defendant allegedly made false material representations regarding the excavator and refused to refund plaintiff's money.

The plaintiff seeks actual and treble damages, attorney’s fees, costs, pre- and post-judgment interest and all other relief to which he may be entitled. He is represented by Paxton N. Crew of Johnson & Crew PLLC in League City.
