33 Restaurant Group LLC alleged to have failed to pay overtime wages

SHERMAN – A Dallas County man alleges he was terminated in retaliation for his complaints of unpaid wages.

Vicente Ambrosio, individually and on behalf of all others similarly situated, filed a complaint on Sept. 21 in the Sherman District of the Eastern District of Texas against 33 Restaurant Group LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff worked for the defendant at its Palio's Pizza Cafe in Irving and was scheduled to work 68 hours per week. He alleges he was only paid straight time and was not classified as an employee.

The plaintiff holds 33 Restaurant Group LLC responsible because the defendant allegedly paid to pay minimum wage and overtime compensation at the rates mandated by the FLSA, retaliated against him and terminated his employment for engaging in protected activity.

The plaintiff requests a trial by jury and seeks unpaid wages and commissions, liquidated damages, attorneys’ fees, costs, expert fees and interest and such other legal or equitable relief. He is represented by Matthew R. Scott and Javier Perez of Scott | Perez LLP in Dallas.
