Family members allege Memorial MRI & Diagnostic LLC, doctor misread CT scan

BEAUMONT – Several Vidor individuals allege a family member's scan for cancer was negligently misread.

Jeffrey C. Chilton, Rebecca Chilton, Merideth Chilton, Macy Chilton, et al. filed a complaint on Sept. 13 in the Jefferson County District Court against Henry S. Lee and Memorial MRI & Diagnostic LLC alleging negligence.

According to the complaint, Jeff Chilton's primary caregiver ordered a CT scan of his abdomen to check for tumors or other abnormalities. The suit states Chilton went to Memorial MRI & Diagnostic LLC on Sept. 25, 2015, for the scan, which was presented to Lee for review. The suit states that Lee inaccurately read the scan and failed to see a tumor on Chilton's appendix. A repeat scan in July 27 found that the tumor had grown and further testing revealed that the tumor was a malignant, appendiceal cancer. 

The plaintiffs allege that they have suffered loss of consortium, financial losses, mental anguish and medical expenses. 

The plaintiffs request a trial by jury and seek monetary relief of more than $100,000 and all other legal and equitable relief. They are represented by Daniel W. Packard and Michael J. Packard of The Packard Law Firm in San Antonio.
