Denbury Resources Inc. alleged to have failed to pay overtime to employees

SHERMAN – A rig welder formerly employed by an independent oil and gas company headquartered in Plano alleges he was paid the same rate for all hours worked.

Billy Reid, individually and on behalf of all others similarly situated, filed a complaint on Sept. 22 in the Sherman Division of the Eastern District of Texas against Denbury Resources Inc. alleging that the oil and gas company violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that during his employment with the defendant between June 2014 and October 2016, he was paid the same hourly rate for all hours worked, including those hours in excess of 40 in a workweek. 

The plaintiff holds Denbury Resources Inc. responsible because the defendant allegedly classified all of its rig welders as independent contractors and paid them the same hourly rate for all hours worked, with no overtime compensation.

The plaintiff requests a trial by jury and seeks an order allowing this action to proceed as a collective action, award for unpaid back wages, liquidated damages, attorneys’ fees, costs, interest and and such other necessary and appropriate relief.
