Consumer sues debt collector for telephone harassment

BROWNSVILLE — A consumer is suing Crest Financial Services, a debt collector, citing alleged violation of telephone harassment statutes.

Reginald Eaden of Cypress filed a complaint on Sept. 28 in the U.S. District Court for the Southern District of Texas against Crest, alleging that the debt collector violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that, beginning in October 2013, he repeatedly receive calls to his cellular telephone from the defendant. As a result of defendant's negligent disregard for his rights, he has suffered losses and damages, the complaint says. The plaintiff holds Crest Financial Services responsible because the defendant allegedly continued to make calls using an automatic telephone dialing system and/or prerecorded voice and even after it was informed that its calls were unwanted and had to stop.

The plaintiff requests a trial by jury and seeks actual statutory and treble damages and any further relief as the court deems appropriate. He is represented by Amy Lynn Bennecoff Ginsburg of Kimmel & Silverman PC in Ambler, Penn.
