Houston resident sues debt-collection agency for deceptive practices

BROWNSVILLE — A consumer has filed a class-action lawsuit against Continental Service Group Inc., a collection agency that does business as ConServe, alleging deceptive debt-collection practices.

Angeline Morris of Houston, individually and on behalf of all others similarly situated, filed a complaint on Sept. 29 in the U.S. District Court for the Southern District of Texas against Continental Service Group Inc., alleging that the collection agency violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that as a result of the defendant's conduct, she will suffer financially if obligated to pay a contingency fee. The plaintiff holds Continental Service Group Inc responsible because the defendant allegedly unlawfully attempted to assess collection costs of $231.80, representing 25 percent of the alleged principal debt.

The plaintiff requests a trial by jury and seeks an order declaring this action to maintain as a class action and certifying her as class representative and her counsel as class counsel, award for actual and statutory damages, interest, costs, attorneys’ fees and any further relief the court deems proper. She is represented by Daniel Zemel of Zemel Law LLC in Kearny, N.J., and Yitzchak Zelman of Marcus Zelman LLC in Ocean, N.J.
