BEAUMONT — A husband and wife are suing Earle Thornhill and Christus Health Southeast Texas, which does business as Dubuis Hospital of Beaumont, alleging that insufficient measures were taken to prevent the wife's paralysis in both her legs.
Mary Gobert and Rodney Gobert filed a complaint on Sept. 21 in the Jefferson County District Court against the defendants, alleging that they failed to take adequate fall-prevention measures.
According to the complaint, the plaintiffs allege that on Jan.15, 2016, Mary Gobert fell while attempting to go to the bathroom on her own after being admitted to a nursing facility. Her back pain immediately began to worsen until she could no longer walk, the complaint said. She has allegedly suffered pain and suffering, mental anguish, impairment, disfigurement and medical expenses. The plaintiffs hold Earle Thornhill and Christus Health Southeast Texas responsible because the defendants allegedly failed to respond and address Mary Gobert's deteriorating condition and negligently allowed her to get worse, develop bed sores and deteriorate until she was paralyzed.
The plaintiffs request a trial by jury and seek actual damages, pre- and post-judgment interest, costs of court and other legal and equitable relief. They are represented by Daniel W. Packard and Michael A. Packard of the Packard Law Firm in San Antonio and Clint Brasher of Brasher Law Firm in Beaumont.
