Comcast faces lawsuit over $13K billing dispute

HOUSTON – A Harris County woman brought a lawsuit against Comcast over an unresolved billing dispute.

In court papers filed Sept. 29 in the Harris County 189th District Court, Karlene Poll claims the Philadelphia-based telecommunications company did not refund her after she notified it about an error in a late 2015 payment.

Poll explains that she accidentally remitted nearly $13,000 to Comcast when she really meant to send $128.92, stating she was “in a fog” following her husband’s death.

The plaintiff then spoke to Comcast was reportedly guaranteed a refund check in the amount she initially paid. According to the suit, Poll never retrieved the subject funds.

Employed as a staff attorney, Poll hired legal counsel to assist her in resolving the dispute. Poll’s counsel sent an email to Comcast expressing her intention to end said dispute and willingness to accept the refund plus $1,000 in statutory damages under the Texas Theft Liability Act and $1,500 in attorney’s fees.

The respondent, however, failed to oblige the request in the email, the complaint asserts.

Poll is represented by attorneys Nicholas J. Lanza and Al Durrell of the Lanza Law Firm, P.C. in Houston.
