Texas City man alleges tree branch on neighboring vacant property damaged house

GALVESTON – A Texas City man is seeking damages allegedly caused by a tree branch to his property.

Dean McNeely filed a complaint on Oct. 5 in the Galveston County District Court against F.E. Duvall alleging negligence.

According to the complaint, the plaintiff alleges that a house on his property was damaged when a branch from a tree on the defendant's premises fell on it. The suit states the defendant's property had been vacant for some time.

The plaintiff holds Duvall responsible because the defendant allegedly negligently maintained a dangerous condition on his premises.

The plaintiff seeks actual damages, pre- and post-judgment interest, costs of court and such other and further relief that are just and right. He is represented by John C. Cunningham in Bellaire.
