Man alleges Tray-Tec failed to provide safety harness for tower work

HOUSTON – A Harlingen man claims that he was injured while working because he was not provided safety gear.

Adrian Gutierrez filed a complaint on Oct. 10 in the Harris County District Court against Tray-Tec Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 15, 2015, he sustained serious and permanent injuries and damages when he slipped and fell after he was ordered to go up a tower without a safety harness and remove trays from the inside. He alleges he has suffered medical expenses, pain and suffering, mental anguish and physical impairment. 

The plaintiff holds Tray-Tec Inc. responsible because the defendant allegedly failed to plan the job correctly, failed to provide proper lookout for plaintiff's safety and failed to provide proper safety gear.

The plaintiff seeks compensatory and punitive damages and such other relief that are lawful and equitable. He is represented by Leslie Sachanowicz of Calfas Law Group PLLC in San Antonio.
