Paton Engineers and Constructors alleged to have failed to pay correct rate for overtime work

HOUSTON – A Fort Bend County woman alleges her former full-service engineering, construction, automation and project management firm employer only paid her straight time instead of the correct wage rate for overtime work.

Andrea Patai, individually and on behalf of all others similarly situated, filed a complaint on Oct. 16 in the Houston Division of the Southern District of Texas against Paton Engineers and Constructors (CA) LLC and Paton Engineers and Constructors (U.S.) Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants as a piping designer from February 2016 to June 2017. She alleges that she regularly worked in excess of 40 hours per week without receiving overtime wages for all overtime hours worked. 

The plaintiff holds Paton Engineers and Constructors (CA) LLC and Paton Engineers and Constructors (U.S.) Inc. responsible because the defendants allegedly refused to compensate the plaintiff for hours worked in excess of 40 hours per week at a rate of no less than one-and-one-half times her regular rate of pay and failed to maintain accurate time and pay records.

The plaintiff requests a trial by jury and seeks an order allowing this action to proceed as a collective action, award for unpaid overtime wages, liquidated damages, attorney’s fees and costs and all such other and further relief.
