Tanger Outlets operator alleges builders failed to construct building to meet specifications

GALVESTON – The operator of a Tanger Outlets mall in Texas City alleges the building has defects because of the negligence of contractors and subcontractors.

Galveston Outlets LLC filed a complaint on Oct. 16 in the Galveston County District Court against DPR Construction Inc., Hardin Construction LLC, Joslin Construction Co. Inc. et al. alleging breach of contract and other counts.

According to the complaint, the plaintiff's mall was completed in October 2012. It alleges that as a result of defendants' negligence, plaintiff's shopping center in Texas City suffered construction defects, including but not limited to cracking on the floor slabs and exterior hardscape, damage to walls and door frames and damage to tenant fixtures. 

The plaintiff holds DPR Construction Inc., Hardin Construction LLC, Joslin Construction Co. Inc., et al. responsible because the defendants allegedly failed to construct or deliver an outlet shopping center that meets the necessary specifications and negligently used inappropriate fill soil beneath the floor slabs.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million and all other just and proper relief. It is represented by David J. Beck, Michael E. Richardson and Parth S. Gejji of Beck Redden LLP in Houston.
