Woman alleges Fingerhut, credit bureaus reported derogatory information

TYLER – A Smith County resident alleges that inaccurate information was reported on her credit report.

Maria Almaraz filed a complaint on Oct. 16 in the Tyler Division of the Eastern District of Texas against Bluestem Brands Inc., doing business as Fingerhut; Equifax Information Services LLC; Experian Information Solutions Inc.; and TransUnion LLC alleging that they violated the Fair Credit Reporting Act.

According to the complaint, the plaintiff opened a Webbank/Fingerhut credit card in August 2012. The suit states that beginning in August 2016, she experienced financial troubles and was unable to continue making payments on her credit card. She alleges she accepted a settlement agreement in December 2016 with Webbank/Fingerhut to settle the account, but Bluestem has reported to the defendant credit bureaus that she still owes a balance.

The suit states the plaintiff disputed the account with the credit bureaus in August 2017.

The plaintiff holds Bluestem Brands Inc., Equifax Information Services LLC, Experian Information Solutions Inc. and TransUnion LLC responsible because the defendants allegedly failed to conduct reasonable investigation and to review all relevant information and continued to furnish and disseminate inaccurate and derogatory credit information.

The plaintiff seeks actual, statutory and punitive damages, pre- and post-judgment interest, attorney’s fees and such other and further relief. She is represented by Stuart Price of Price Law Group APC in Encino, California.
