SHERMAN – An oil change/lube technician has filed a class-action lawsuit against a Plano auto dealership over allegations that he was only paid straight time for overtime work.
Angel Navarro, individually and on behalf of all those similarly situated, filed a complaint on Oct. 16 in the Sherman District of the Eastern District of Texas against Huffines Denton Autos Inc. alleging that the automobile dealer violated the Fair Labor Standards Act.
According to the complaint, the plaintiff was employed by the defendant from February 2015 to June 2017 as an oil change/lube technician. He alleges he was only paid straight time for the hours he worked beyond 40 per week.
The plaintiff holds Huffines Denton Autos Inc. responsible because the defendant allegedly failed to pay technicians at a rate of time-and-one-half their regular rate of pay for all hours they worked over 40 hours a week.
The plaintiff requests a trial by jury and seeks an order recognizing this proceeding as a collective action, all unpaid wages and overtime compensation, liquidated damages, attorneys’ fees, expert fees, costs and expenses and such other relief to which he is entitled.
