Client claims attorney misrepresented her in car wreck case

HOUSTON – Houston attorney Jim Doyle, II and his law firm face a lawsuit from a client who claims they did not prosecute her motor vehicle accident case.

Recent court documents filed on Oct. 12 in the Harris County 55th District Court say that Houston resident Eugenia Morgan sought Doyle’s services in her suit arising from a May 14, 2014, collision in which she was a passenger. According to the original petition, the defendants waited until two years after the event to file the suit on her behalf.

Last April, the Harris County 270th District Court informed the defendants that a hearing was scheduled to determine whether Morgan’s case would be dismissed for want of prosecution. The complaint says that the trial court, however, junked the case.

“During the defendants’ representation of the plaintiff, the defendants did not tell the plaintiff that her case had been dismissed or that it would be dismissed or that there would be a hearing about whether the plaintiff’s car wreck case would or would not be dismissed,” the suit says.

A jury trial is requested.

Morgan is represented by attorney Cletus P. Ernster, III of the Ernster Law Firm PLLC in Houston.
