Woman seeks more than $1 million after fall in Houston parking lot

HOUSTON – A Harris County woman alleges a rock caused her to fall and break both legs in a Houston parking lot.

Carol Allen filed a complaint on Oct. 23 in the Harris County District Court against JPMorgan Chase Bank NA and American Asset Advisers alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 23, 2015, she was severely injured at the defendants' parking lot on Westheimer Road in Houston. She alleges there was a fist-sized rock in the parking lot from a rock garden and that she stepped on the rock when getting out of her vehicle, which caused her to fall and break both legs.

The plaintiff holds JPMorgan Chase Bank NA and American Asset Advisers responsible because the defendants allegedly failed to warn invitees of the known hazards and failed to modify the rock garden to prevent rocks from entering the parking lot.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million and any other general and special relief. She is represented by W. Perry Zivley Jr. and Stephen R. Walker of Chandler, Mathis & Zivley PC in Houston.
