Passenger claims platform on Nutrition & Services for Seniors van collapsed, caused injuries

BEAUMONT – A Jefferson County man claims he was injured when he was caused to fall from his wheelchair because of the negligence of a common carrier.

Willie Buckley filed a complaint on Oct. 20 in the Jefferson County District Court against Nutrition & Services for Seniors alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 3, 2016, he was seriously injured when the exit platform on the defendant's van collapsed, causing him to fall out of his wheelchair. He alleges he has suffered physical and mental pain, loss wages, disfigurement and medical expenses. 

The plaintiff holds Nutrition & Services for Seniors responsible because the defendant allegedly failed to adequately inspect the van's platform before operating it and failed to secure patrons using the platform.

The plaintiff seeks damages in excess of the jurisdictional limits of the court, pre- and post-judgment interest, costs of court and such other and further relief. He is represented by Eric D. Nielsen and Ryan Bill of The Nielsen Law Firm PC in Houston.
