Fox Television Stations states plaintiff has not responded to requests to schedule deposition

HOUSTON – Fox Television Stations LLC has filed a motion to compel discovery in a discrimination claim filed against the company in Houston Division of the Southern District of Texas, stating the plaintiff hasn't responded to requests.

In its Oct. 19 motion, FTS noted that it has complied with discovery request and has worked with Nina Ridge throughout the process. The company claims that Ridge has not reciprocated and has not responded to requests to schedule a deposition.

Ridge filed a complaint in December 2016 alleging that FTS, FTS Inc. and KRIV discriminated against her based on her race and retaliated against her, a violation of the Texas Labor Code. FTS has denied the allegations.

As a result, FTS has asked the court to intervene in the case to compel discovery.

FTS stated in its motion that it served Ridge with discovery requests on July 28 and sought dates in September or October for a deposition.

When Ridge did respond in early September, FTS claims the responses were insufficient. According to the motion, she “failed to provide a single substantive response or produce any responsive documents.”

Though supplements were promised, neither Ridge nor her attorneys allegedly provided any additional information.

In its motion, FTS stated that the court should order Ridge to provide substantive responses to all of the company’s requests for discovery.

Further, FTS maintains that the court should order Ridge to appear for a deposition hearing. It also asks the court to compel Ridge to pay for the company’s expenses for the motion to compel.

As a result, FTS is asking the court to force Ridge to set aside any objections and provide adequate responses to the defendant’s complete responses. It also is seeking any responsive documents that Ridge may possess.

FTS also is seeking dates for a required deposition. It also is seeking repayment of their expenses, including attorney’s fees, associated with the motion to compel.
